Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the websites, applications, and services provided by Pixuntra Labs, Inc. (“Pixuntra,” “we,” “us,” or “our”), together “the Service.”

By creating an account, accessing the Service, or clicking to accept these Terms when prompted, you agree to be bound by them. If you do not agree, do not use the Service.

You must be at least 18 years old and able to enter into a binding contract to use Pixuntra. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization, and “you” refers to that organization.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at any unauthorized use.

You agree not to use the Service to:

• Infringe any third party’s intellectual property or other rights;
• Generate, distribute, or store content that is unlawful, harmful, sexually explicit involving minors, or that depicts a real person without their consent;
• Reverse engineer, scrape, or attempt to extract the underlying models, weights, or training data of the Service;
• Interfere with the integrity or performance of the Service or use it to build a competing product.

We may suspend or terminate accounts that violate these rules, with or without notice.

You retain ownership of any brand assets, prompts, references, or other materials you upload or generate through the Service (“Customer Content”). You grant Pixuntra a limited, worldwide, non-exclusive license to host, process, and display Customer Content solely to operate the Service for you.

Subject to your compliance with these Terms, you own the outputs you generate using the Service. You are responsible for ensuring your use of any output complies with applicable laws and the rights of others.

The Service itself, including its software, models, design, and documentation, is owned by Pixuntra and protected by intellectual property laws.

Paid plans are billed in advance on a monthly or annual basis. Unless otherwise stated, fees are non-refundable. We may change pricing with at least 30 days’ notice for renewals.

Free trials are offered at our discretion and convert to paid plans unless cancelled before the trial ends. Taxes, where applicable, are your responsibility.

Our handling of personal information is governed by the Privacy Policy, which forms part of these Terms. We maintain reasonable administrative, technical, and physical safeguards designed to protect Customer Content.

The Service is provided “as is.” To the fullest extent permitted by law, Pixuntra disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Pixuntra’s aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid us in the 12 months preceding the claim, or (b) one hundred US dollars.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service to you becomes commercially impractical.

Sections that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, and dispute resolution — will survive.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. The state and federal courts of Delaware have exclusive jurisdiction over any dispute arising under or relating to these Terms.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance.
